Virago Wear curates products sourced through selected suppliers and fulfillment partners. Some orders may be processed or shipped by these partners on our behalf. However, your purchase is made from Virago Wear, and questions or concerns about an order placed on our website should be directed to us.

We make reasonable efforts to describe and display our products accurately. Product colors may appear differently depending on photography, lighting, display settings, and device resolution. Minor variations may also occur where disclosed in the product description.

Product details, materials, measurements, sizing information, availability, and images are provided to help customers make informed purchasing decisions. Customers should review the complete product page and applicable sizing information before ordering.

If an item arrives damaged, defective, incorrect, or materially different from its product description, please contact us promptly in accordance with our Return Policy and applicable law.

If we cancel a paid order or item because of an inventory, pricing, availability, product-information, or processing error, the amount paid for the canceled order or item will be returned to the original payment method.

SECTION 7 – SHIPPING AND DELIVERY

Delivery dates displayed on product pages, at checkout, or in order communications are estimates and are not guaranteed unless expressly stated otherwise.

Orders containing multiple items may be shipped separately and may arrive at different times.

Customers are responsible for providing a complete and accurate shipping address. If you discover an address error, contact us immediately. We cannot guarantee that an address can be changed after an order has entered processing or been dispatched.

If tracking indicates that an order is delayed, lost, or delivered but the package cannot be located, please contact us at support@viragowear.com. We will assist with the carrier investigation and determine the appropriate resolution based on the circumstances and applicable law.

SECTION 8 – RETURNS, EXCHANGES, AND STORE CREDIT

Return requests, eligibility requirements, exclusions, deadlines, return authorization requirements, exchange conditions, and store-credit terms are governed by our Return Policy:

Approved returns are issued as store credit in the form of a Virago Wear e-gift card unless otherwise stated or required by applicable law.

Products identified as final sale are not eligible for return, exchange, or store credit, except where a remedy is required by applicable law.

Nothing in the Return Policy or these Terms limits any rights or remedies that cannot legally be excluded.

SECTION 9 – OPTIONAL TOOLS AND SERVICES

We may provide access to optional tools or services offered by third parties. We may not monitor or control these third-party tools.

Optional third-party tools are provided on an “as available” basis, subject to applicable law. Your use of an optional tool is at your discretion, and you should review the third party’s applicable terms and privacy practices.

The involvement of a supplier, carrier, payment processor, application provider, or fulfillment partner does not require customers to direct product or order complaints to that third party.

SECTION 11 – USER COMMENTS, REVIEWS, FEEDBACK, AND SUBMISSIONS

If you submit reviews, photographs, comments, suggestions, contest entries, creative ideas, or other materials, you represent that you have the right to submit them.

Unless we agree otherwise in writing, you grant Virago Wear a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, translate, distribute, and display submitted content for operating, improving, or promoting our business and Service, subject to applicable law and our Privacy Policy.

We are not obligated to keep unsolicited submissions confidential, pay compensation for them, or respond to them.

We may monitor, edit, decline, or remove content that we reasonably determine is unlawful, threatening, defamatory, obscene, fraudulent, abusive, misleading, infringing, or otherwise violates these Terms.

Your submissions must not violate another party’s copyright, trademark, privacy, publicity, contractual, or other legal rights. They must not contain malware or materially false or misleading information.

SECTION 13 – ERRORS, INACCURACIES, AND OMISSIONS

We reserve the right to correct errors, update information, or cancel an affected order when reasonably necessary and permitted by law.

If we cancel an order after payment because of an error, we will return the amount paid for the canceled order or item to the original payment method.

To the extent permitted by applicable law, you agree to indemnify and hold harmless The House of CO-KY LLC, doing business as Virago Wear, and its affiliates, officers, directors, employees, agents, contractors, licensors, suppliers, fulfillment partners, and service providers from third-party claims resulting from your material breach of these Terms, violation of applicable law, or infringement of another party’s rights.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed where necessary. The remaining provisions will continue in effect.

SECTION 19 – TERMINATION

These Terms remain effective until terminated by you or us.

You may terminate your use of the Service at any time by discontinuing your use of the website. We may suspend or terminate access if we reasonably believe that you have materially violated these Terms or applicable law.

Termination does not affect rights, payment obligations, liabilities, or remedies that arose before termination.

SECTION 20 – ENTIRE AGREEMENT

These Terms, together with the policies and notices posted on our website, constitute the agreement between you and Virago Wear concerning your use of the Service.

Our failure to enforce a provision does not waive our right to enforce that provision later.

Any ambiguity will be interpreted fairly and in accordance with applicable law and will not automatically be construed against either party.

These Terms and any separate agreement through which we provide the Service are governed by the laws of the State of Florida, United States, without limiting any mandatory consumer protections or rights that may apply in the customer’s place of residence.

SECTION 22 – FORCE MAJEURE

Virago Wear will not be considered in breach of these Terms for a delay in performing an obligation when the delay is directly caused by an event beyond our reasonable control that we could not reasonably have prevented or overcome through commercially reasonable diligence.

Such events may include natural disasters, hurricanes, floods, fires, earthquakes, severe weather, epidemics, pandemics, war, terrorism, civil unrest, governmental orders or restrictions, customs closures, embargoes, widespread labor disruptions, transportation shutdowns, widespread carrier or postal-service interruptions, widespread utility or telecommunications failures, or cyberattacks that are not caused by our failure to maintain commercially reasonable safeguards.

This section does not apply to ordinary inventory shortages, routine carrier delays, increases in operating or supplier costs, lack of funds, or the failure of a supplier or fulfillment partner unless that failure is itself directly caused by an event described above that is beyond our reasonable control.

When a force majeure event affects an order, we will make commercially reasonable efforts to reduce the delay, notify affected customers when reasonably practicable, and resume performance as soon as reasonably possible.

A force majeure event does not excuse our obligation to comply with applicable laws governing shipment delays, order cancellations, refunds, or consumer rights. If merchandise cannot be shipped within the promised or legally required time, customers will be given any notice, choice to consent to a delay, cancellation option, or refund required by applicable law.

Nothing in this section limits any consumer right or remedy that cannot legally be waived or excluded.

SECTION 23 – CONSUMER RIGHTS

Nothing in these Terms excludes, restricts, or limits any rights or remedies that cannot legally be excluded under applicable consumer-protection law.

If any provision conflicts with a mandatory consumer-protection requirement, the mandatory legal requirement will control to the extent of that conflict.
